Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the AcrePlus platform (“Service”), operated by AcrePlus (“AcrePlus”, “we”, “us”). By creating an account or using the Service, you (“Customer”) agree to these Terms on behalf of your organization.

1. The Service

AcrePlus is a business-to-business software-as-a-service platform for tracking farm product applications (fertilizers, pesticides, herbicides, fungicides, adjuvants), California INMP compliance reporting, food-safety records, and cost tracking. The Service is provided on a multi-tenant basis; each Customer organization (“tenant”) is logically isolated from every other tenant.

2. Accounts and responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information, to keep it current, and to notify us promptly of any unauthorized use. Managers and admins are responsible for the team members they invite and the roles they assign.

You are responsible for the accuracy of the data you enter. AcrePlus provides compliance calculations and reporting tools as aids; you remain solely responsible for verifying that your records meet applicable regulatory requirements before submission to any authority.

3. Acceptable use

You agree not to:

  • access or attempt to access another tenant’s data;
  • reverse engineer, scrape, or overload the Service;
  • upload unlawful, infringing, or malicious content;
  • use the Service to violate any applicable law or regulation; or
  • resell or sublicense the Service without our written consent.

4. Data ownership

Customer owns all data entered into the platform; AcrePlus acts solely as a processor.

You retain all right, title, and interest in the field, product, application, task, team, and compliance records you create (“Customer Data”). We claim no ownership over Customer Data. We process Customer Data only to provide and improve the Service, as described in our Privacy Policy and Data Processing Agreement. You may export your complete Customer Data at any time from Settings → Data & Privacy.

5. Intellectual property

The Service, including its software, design, and documentation, is and remains the property of AcrePlus and its licensors. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service for your internal business purposes during the term of your subscription. No other rights are granted by implication.

6. Third-party services

The Service relies on third-party sub-processors (including Supabase, Replit, Twilio, SendGrid, and Cloudflare) to operate. Your use of the Service is also subject to those providers’ terms where applicable. The current sub-processor list is maintained in our Data Processing Agreement.

7. Fees and subscriptions

Paid plans, seat limits, trial periods, and billing terms are as described at the time of purchase. Fees are non-refundable except where required by law.

8. Warranties and disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. AcrePlus does not warrant that compliance calculations are error-free or that the Service will be uninterrupted.

9. Limitation of liability

To the maximum extent permitted by law, AcrePlus will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of or related to the Service.

10. Service levels

We aim to keep the Service available and performant.

11. Term and termination

Either party may terminate for material breach that remains uncured after written notice. On termination, you may export your Customer Data, after which we will delete or return it in accordance with the Data Processing Agreement and the retention period stated in our Privacy Policy. Sections that by their nature should survive termination will survive.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance.

13. Governing law and disputes

These Terms are governed by applicable law.
